Types Of Child Custody
There are two types of child custody; physical custody and legal custody. Physical custody describes where the children will spend their time, whereas legal custody determines which parent is responsible for all decision making on behalf of the children. Except in cases where there is abuse or domestic violence, parents usually have 50-50 joint legal custody. When making physical custody arrangements, the court starts out with the goal of setting up an arrangement where each parent has the children for 50% of the time. For most families, a 50-50 split is not feasible due to the proximity of each spouse’s home to the children’s school, work schedules and other situations. That is where the legal team at the Law Offices of J. P. Reilly, JR., Esquire PC steps in to negotiate an agreement that is fair and takes your needs and wishes into account.
Joint Physical Custody Versus Sole Physical Custody
Joint physical custody is where the child/children divide the time they spend in the homes of each parent. The amount of time spent in each home is based primarily on what is in the best interests of the children. Sole custody is where the child/children live with one parent full time. This does not necessarily mean that the noncustodial parent is forbidden from seeing the children. Visitation arrangements are often set up as part of the divorce proceedings.
